Elkington is sued for alleged breach of contract – Inspiration Landing in trouble?

SHEFFIELD – A lawsuit has been filed in Colbert County Circuit Court which alleges that Inspiration Landing Developer, John Elkington and some associated business interests, located in the Memphis area, breached several verbal contracts with a development consulting company. The consulting company, also located in Memphis, is Business Enhancement Associates, LLC, whose principal is Carl Raff, of Cordova, Tennessee.

Developer John Elkington reveals re-imagined plans for Inspiration Landing

Paragraph 1 of the complaint states that Business Enhancement Associates, LLC entered into several verbal contracts with Elkington; Inspiration Landing Development, LLC; Furnace Hill Development, LLC; and 20th Avenue West Holdings, LLC. The lawsuit hinges on a number of alleged verbal agreements which were broken by Elkington, et. al. These agreements, according to the complaint began in 2015 and continued up through 2019. The Plaintiff states that, “… provide services on The Project for the benefit of the Defendants, as to which Plaintiff fully performed, and submitted regular written agreements to the Defendants, (which were not signed) and regularly submitted billing for the hours of services provided, all of which have never been paid.”

The total compensatory amount the Plaintiff is asking the Court for is $531,604.00, plus interests and other costs.

The Quad Cities Daily has reached out to Mr. Elkington for a statement.

Sheffield Mayor Steve Stanley

Sheffield Mayor, Steve Stanley told The Quad Cities Daily, that the City still has full confidence in the Inspiration Landing project. He said, “I have seen the plans, I have spoken with some of the companies which intend to add to the Development, and I speak with John Elkington on a regular basis. I see no issue whatsoever with the viability of the project.” When asked when he expects some material work to re-commence, Stanley said that he expects progress to resume within the next several months. The Development hit a snag in it’s progress when the COVID-19 pandemic hit almost 3 years ago. Now that life is slowly returning back to normal, he said work should begin in earnest soon.
