MONTGOMERY – The school choice law, passed by the Alabama Legislature in 2013 to the pleasure of many politically conservative constituents, was thrown out today. Alabama Circuit Judge Gene Reese ruled that the law violates several sections of the Alabama State Constitution.
The ruling was issued in a lawsuit filed last August by Senator Quinton Ross, a Democrat from Montgomery. The lawsuit was supported by the Alabama Education Association. This is the latest foray in the battle between the AEA and the fiscally conservative new Republican movement that took over the State Legislature in 2009.
The decision was put on hold by Judge Reese to allow for the decision to be appealed up the judicial ladder.
The lawyer for three families who intervened in the lawsuit promised an appeal. Bert Gall, who represents the parents was quoted as saying, “This ruling is both disappointing and wrong. Alabama parents should be able to choose the best education for their children.”
