ALBERTVILLE-At approximately 7:30 p.m. on February 3, 2026, officers responded to the 100 block of Bobwhite Drive to a reported fight involving a gun. Once on scene, officers located an adult male victim who had allegedly been assaulted by his adult brother. Officers were able to get the victim to safety and he received treatment for his injuries by paramedics. Officers later learned that the suspect had allegedly fired gunshots at the victim prior to officer’s arrival.
As officers approached the suspect’s residence, they were met with gunfire. Officers returned fire, and the suspect, later
identified as Nicolas Pascual Gaspar, fled back into the residence. Additional officers arrived on scene, a perimeter was established, and officers attempted to have Gaspar exit the residence peacefully.

After an approximately two-hour standoff, Gaspar agreed to come out of the residence and was taken into custody without further incident.
Gaspar was transported from the scene by ambulance to Huntsville Hospital for treatment of a gunshot wound. He was discharged from the hospital on February 4, 2026 and initially booked into the Albertville City Jail on unrelated outstanding warrants. He was later transported to the Marshall County Jail where he was booked on three counts of Attempted Murder and one count of Illegal Possession of a Firearm. Gaspar’s bond for these charges was set at $1 million. In addition to State charges, a Federal immigration detainer has been placed on Gaspar through the Immigration and Customs Enforcement Agency.
The department would like to express its appreciation to the following local agencies for their assistance during this incident: Marshall County Joint Special Response Team, Marshall County Sheriff’s Department, Marshall County 911, Guntersville, Boaz, and Douglas Police Departments, Marshall County Drug Enforcement Unit, Marshall County District Attorney’s Office, Albertville Fire & Rescue, and Marshall Health Systems.
We would also like to thank the following agencies for their assistance with this investigation: Alabama Law Enforcement’s State Bureau of Investigation, Federal Homeland Security Investigations, Immigration and Customs Enforcement, and the Bureau of Alcohol, Tobacco, and Firearms.
We are extremely grateful that no officers were injured during this incident and would like to commend all those involved for the bravery and professionalism they displayed in helping bring this dangerous situation under control.
Pursuant to department policy and protocol for all officer-involved shootings, the Alabama Law Enforcement Agency’s State Bureau of Investigation has been contacted and will conduct an independent investigation into the incident. This is an ongoing investigation, and additional information will be released as it becomes available through the Alabama Law Enforcement Agency.
