DECATUR-A waarant was issued by the Decatur Police Department for a man suspected in the theft at the Wa-Mart in Decatur. Here is how the Decatur Police describe the events leading up to the arrest of one man:
“SYNOPSIS OF OFFENSE & ARREST:
On 11/9/14, Loss Prevention Associates working at Wal-Mart noticed a black male concealing clothing inside his clothing. The male then attempted to leave the store without paying for the merchandise.
The male was stopped by Loss Prevention. He then ran from the employees into the parking lot. The employees pursued him into the parking lot, where he stopped and faced them, hiding his hands and telling them he had a gun. This caused the employees to back off and the male ran again with the merchandise and got into a car and left the area.
The male was later identified as 18 year old Jaylon Deshun Swoope of Decatur.
Sgt Silvestri obtained a warrant for Swoope’s arrest. Ofc Derek Annerton located Swoope who was charged with Robbery in the First Degree, a Class “A” Felony.
Section 13A-8-41
Robbery in the first degree.
(a) A person commits the crime of robbery in the first degree if he violates Section 13A-8-43 and he:
(1) Is armed with a deadly weapon or dangerous instrument; or
(2) Causes serious physical injury to another.
(b) Possession then and there of an article used or fashioned in a manner to lead any person who is present reasonably to believe it to be a deadly weapon or dangerous instrument, or any verbal or other representation by the defendant that he is then and there so armed, is prima facie evidence under subsection (a) of this section that he was so armed.
(c) Robbery in the first degree is a Class A felony.”
