HUNTSVILLE-The investigation into the shooting that took place this past Tuesday, April 15th at Wal-Mart has concluded. The shooting incident was between an off-duty Morgan County Sheriff’s Deputy,Brian Fullford and a man with outstanding warrants for Felony Burglary in Morgan County, David Horton. According to the investigation Deputy Fullford attempted to arrest Horton he (Horton) sustained a minor gunshot wound.
Horton was taken to Huntsville Hospital where he was treated and released into custody of the Morgan County Sheriff’s Department. Horton was transported to the Morgan County Jail where he was booked on a Felony charge.
Huntsville Police investigators presented their findings to the Madison County District Attorney’s Office after which Brian Fullford was charged with Second Degree Assault and had bond set at $5,000. Fullford was released on bond after being booked into jail.
Here is a statement released by Sheriff Ana Franklin of the Morgan County Police Department:
“After an incident involving an off duty Morgan County Deputy, Brian Fullford, who discharged a weapon injuring a suspect during an attempted felony arrest , the Madison County District Attorneys Office obtained a warrant for Assault 2nd degree for Deputy Fullford. I was notified this afternoon of the active warrant. I accompanied Deputy Fullford to the Madison County Jail where he was arrested, booked and released on a 5000 dollar bond. Fullford has now been placed on administrative leave without pay until Monday morning when I will conduct an administrative hearing and a formal determination will be made as to his employment status with the Sheriff’s Office. This is an unfortunate situation and my prayers are extended not only to Deputy Fullford , but also to the family of Mr Horton. I am thankful to HPD for the professional and thorough manner in which they conducted this investigation. Please remember my office and all my staff during this difficult time for us.
