I wrote an article two weeks ago and child support and social security. At the time that I submitted the article, I liked it. When I read it, I realized that I had included too much information and it didn’t make the points that I thought important. Here’s my second try.

 

First, if you are injured or ill and you can’t pay child support, you have to let the court system know. An agreement between you and the person you pay does not matter to the court. The court doesn’t have to follow it and so it does no good to reach an oral agreement or even a written agreement with the other party.

 

Secondly, you can file a request to suspend or reduce your child support even if you do not have any money. There is a form that you have to fill out that is called an Affidavit of Substantial Hardship. This will waive or put off the payment of the costs required to file a motion to reduce or suspend your child support.

 

Third, the date you file a request to change your child support is the first date that a court can consider to go back to and reduce your child support.

 

When a person is receiving social security disability (SSDI), usually the child gets a portion of a parent’s social security that takes the place of child support. Sometimes, people haven’t worked enough to get social security disability and those people get social security supplemental income, commonly known as SSI. People who receive SSI get no additional money for dependents. SSI cannot be considered income from which to pay child support and that is part of the rules of child support. Some people get some SSDI and some SSI. Only the SSDI portion of their income can be considered as income from which to pay child support.
